3. Website Information
Information published on the website is provided for general informational and professional purposes.
ECU Tuning AI makes reasonable efforts to keep website information accurate and up to date.
However, technical information, vehicle specifications, software versions, compatibility information and performance figures may change and may vary between individual vehicles.
Website content should therefore not be considered a substitute for vehicle-specific technical diagnosis or professional assessment.
4. Service Requests and Quotations
A request submitted through the website does not automatically constitute acceptance of an order.
Before a service is performed, ECU Tuning AI may request additional technical information, files or vehicle identification details in order to assess the request.
Where appropriate, ECU Tuning AI will provide a quotation or confirmation specifying the relevant service, price and delivery conditions.
An order is considered accepted when ECU Tuning AI expressly confirms the order or begins performing the agreed service following the customer's authorization.
5. Customer Information and Files
The customer is responsible for providing accurate and complete information necessary to perform the requested service.
Depending on the service, this may include:
- vehicle make and model;
- engine information;
- ECU or TCU identification;
- hardware number;
- software number;
- original ECU/TCU files;

The customer must ensure that any file, software or information supplied to ECU Tuning AI has been obtained lawfully and that the customer is entitled to provide it for processing.
6. Original Files
Original ECU and TCU files supplied by customers remain the responsibility of the customer.
Customers are strongly advised to maintain a secure backup of all original files and relevant vehicle information.
ECU Tuning AI does not guarantee the permanent storage or availability of customer-supplied files unless a separate written storage or backup service has been agreed.
7. Modified Software Files
Software files are prepared according to the technical information, original files and requirements available at the time the service is performed.
The resulting file is intended for the specific technical configuration agreed with the customer.
A file prepared for one ECU/TCU configuration must not automatically be assumed to be compatible with another vehicle, ECU, TCU or software version.
The customer must verify compatibility before programming the vehicle.
8. Vehicle and Hardware Condition
The customer is responsible for ensuring that the vehicle and its mechanical and electronic systems are in suitable condition before any software modification is installed.
This includes, where applicable:
- engine condition;
- transmission condition;
- ECU/TCU condition;
- sensors;
- actuators;
- wiring;
- battery and power supply;
- cooling system;
- turbocharger and related components;
- fuel system;
- emissions-related components;
- other relevant mechanical or electronic components.
Software calibration cannot correct pre-existing mechanical or electronic faults.
9. Programming and Installation
Unless expressly agreed otherwise, ECU Tuning AI supplies software files and related digital services and does not perform the physical programming of the vehicle.
The customer or its appointed professional is responsible for:
- selecting suitable programming equipment;
- maintaining a stable power supply;
- performing the correct programming procedure;
- verifying ECU/TCU compatibility;
- maintaining appropriate backups;
- following the equipment manufacturer's procedures.
ECU Tuning AI cannot control the installation environment or equipment used by the customer.
10. Technical Testing
Where stated by ECU Tuning AI, software files may be developed and/or tested using professional calibration procedures, tools and technical validation processes.
Testing does not constitute a guarantee that a file will produce identical results on every vehicle.
Vehicle condition, fuel quality, environmental conditions, hardware configuration, previous modifications and other factors may affect the final result.
11. Performance Figures
Any performance figures, estimated gains or technical values published on the website or communicated during the service process are indicative unless expressly guaranteed in writing for a specific vehicle and configuration.
Actual results may vary depending on:
- vehicle condition;
- engine condition;
- transmission condition;
- fuel;
- environmental conditions;
- vehicle hardware;
- software version;
- previous modifications;
- installation quality.
Performance figures should therefore not be considered guaranteed results for every vehicle.
12. Emissions and Regulatory Compliance
ECU Tuning AI provides technical software engineering services and does not encourage the use of software modifications in violation of applicable laws, emissions regulations, safety requirements or vehicle inspection requirements.
Any modification affecting emissions-related systems, safety systems or other regulated vehicle functions must only be used where permitted by applicable law.
The customer is responsible for determining whether a requested modification is lawful for the intended use of the vehicle and in the jurisdiction where the vehicle is operated.
13. Supported Vehicle Categories
ECU Tuning AI may provide services for different types of vehicles, including:
- Cars;
- Motorcycles;
- Trucks;
- Agricultural vehicles;
- Marine vehicles.
Availability depends on the specific vehicle, control unit, software version and technical requirements.
The fact that a vehicle category is listed on the website does not guarantee that a particular ECU/TCU or software version is supported.
14. Payments
Payment terms are agreed before the relevant service is provided.
PayPal is currently accepted as a payment method.
Additional payment methods may be introduced in the future.
Services or digital files may be delivered only after the applicable payment requirements have been satisfied, unless otherwise agreed in writing.
15. Delivery of Digital Files
Where a service involves the delivery of a digital file, the file may be delivered electronically using the communication method agreed with the customer.
The customer is responsible for providing a valid email address or other required contact information.
Delivery times may vary depending on:
- technical complexity;
- file analysis requirements;
- availability of technical information;
- communication with the customer;
- requested revisions;
- third-party technical information.
Any delivery time communicated by ECU Tuning AI should be considered an estimate unless expressly confirmed as binding in writing.
16. Revisions and Technical Corrections
Where technically appropriate, ECU Tuning AI may provide revisions or corrections to a delivered file.
Any revision must relate to the original service and technical specification agreed with the customer.
A request involving a different vehicle, different ECU/TCU, different hardware configuration or substantially different technical requirements may constitute a new service.
17. Intellectual Property
Unless otherwise agreed in writing, ECU Tuning AI retains all intellectual property rights relating to:
- original calibration methodologies;
- proprietary technical solutions;
- software development processes;
- databases;
- documentation;
- website content;
- graphics;
- logos;
- texts;
- proprietary technical materials.
The purchase or delivery of a software file does not automatically transfer ownership of ECU Tuning AI's intellectual property.
18. Prohibited Redistribution
Unless expressly authorized in writing, customers may not:
- resell ECU Tuning AI files;
- redistribute files to third parties;
- publish files online;
- upload files to public databases;
- make files publicly available;
- commercially exploit ECU Tuning AI proprietary files or technical materials outside the agreed service.
This restriction does not prevent a customer from using a supplied file for the specific vehicle and purpose for which the service was requested, subject to applicable law and the agreed terms.
19. ECU Tuning AI Database and Technical Information
ECU Tuning AI may maintain internal databases containing original files, modified files, ECU/TCU information, calibration references and other technical information.
Such databases constitute proprietary business resources.
The existence of a file or vehicle reference in an ECU Tuning AI database does not grant any person access to the underlying file or database.
No database content is made available for unrestricted download through the website unless expressly stated otherwise.
20. Third-Party Tools and Software
ECU Tuning AI may use professional third-party software, diagnostic equipment, calibration tools and technical databases in the performance of its services.
The operation and availability of third-party products are subject to the terms, licenses and technical limitations imposed by their respective manufacturers or providers.
ECU Tuning AI does not claim ownership of third-party trademarks, software or proprietary technologies.
21. Limitation of Liability
To the maximum extent permitted by applicable law, ECU Tuning AI shall not be responsible for damage or loss arising from circumstances outside its reasonable control, including:
- defective or damaged ECU/TCU hardware;
- pre-existing mechanical or electronic faults;
- incorrect information supplied by the customer;

- modifications performed by third parties;
- use of the vehicle in conditions for which it was not designed.
Nothing in these Terms & Conditions excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
22. No Guarantee Regarding Third-Party Installation
Where ECU Tuning AI only supplies a digital file and does not perform the physical installation or programming, ECU Tuning AI cannot control the installation process.
Any damage caused by the installation equipment, programming procedure, power interruption, vehicle hardware or actions of the installer is outside ECU Tuning AI's control.
Customers should therefore use appropriate professional equipment and qualified personnel.
23. Consumer Rights
ECU Tuning AI primarily provides professional services and works extensively with workshops, tuners, automotive professionals and other businesses.
However, where services are provided to a consumer, any mandatory rights and protections granted to that consumer under applicable law remain unaffected by these Terms & Conditions.
Nothing in these Terms & Conditions is intended to exclude or restrict mandatory consumer rights.
For digital content and digital services supplied to consumers, applicable statutory conformity and remedy rules may apply.
24. Cancellation and Refunds
Cancellation, refund and withdrawal rights depend on the nature of the service, the customer's status and the applicable law.
For business customers, the cancellation and refund terms agreed in the relevant quotation or order confirmation shall apply.
For consumers, any mandatory statutory cancellation, withdrawal, conformity or refund rights remain applicable.
Where a digital service or digital file has already been supplied, the legal consequences of cancellation or withdrawal will depend on the applicable legislation and the specific circumstances of the transaction.
25. Force Majeure
ECU Tuning AI shall not be responsible for delays or failure to perform caused by events beyond its reasonable control, including:
- internet or telecommunications failures;
- hosting or infrastructure failures;
- widespread technical outages;
- natural disasters;
- war or civil disturbances;

The website may occasionally be unavailable due to maintenance, updates, security measures, technical problems or circumstances outside ECU Tuning AI's control.
27. Links to Third-Party Websites
The website may contain links to external websites or services.
ECU Tuning AI is not responsible for the content, availability, security or privacy practices of third-party websites.
Users should review the terms and privacy policies of third-party services before using them.
28. Intellectual Property of the Website
All original content published on the ECU Tuning AI website, including texts, graphics, layouts, images, logos and other materials, is protected by applicable intellectual property laws unless otherwise stated.
Unauthorized reproduction, distribution, modification or commercial use is prohibited.
29. Amendments to These Terms
ECU Tuning AI may update these Terms & Conditions when necessary to reflect changes to:
- services;
- website functionality;
- business operations;
- technology;
- applicable legislation.
The updated version will be published on this page.
The version applicable to a specific order or service will be determined in accordance with the terms communicated and agreed at the time of that order.
30. Applicable Law
These Terms & Conditions are governed by the laws applicable in Italy, without prejudice to any mandatory rights or protections that may apply to consumers under applicable law.
For business-to-business relationships, the competent jurisdiction shall be determined in accordance with applicable Italian law and any specific written agreement between the parties.
Nothing in this clause is intended to deprive consumers of any mandatory jurisdiction or legal protection available to them under applicable law.
