This Software & File Disclaimer applies to ECU Tuning AI software files, ECU and TCU calibration files, original files, modified files, technical files, calibration data, technical information and related digital materials supplied or processed by ECU Tuning AI.
ECU Tuning AI provides professional software engineering and calibration services. The customer is solely responsible for the lawful installation and use of any supplied software or digital file.
1. Professional Software Engineering
ECU Tuning AI develops and processes software files using professional calibration methodologies, engineering procedures and specialized software and hardware tools.
Depending on the service requested, files may be:
- analyzed;
- modified;
- calibrated;
- checked;
- compared;
- technically reviewed;
- tested or validated where applicable.
The level and type of validation may vary depending on the specific service, vehicle, ECU/TCU, software version and technical information available.
The term "tested" does not constitute a guarantee of absolute compatibility or identical results under every possible vehicle condition.
2. Road Use, Homologation and Legal Compliance
IMPORTANT LEGAL NOTICE
ECU and TCU software modifications may alter the characteristics, performance, emissions behavior or other technical parameters of a vehicle.
Under applicable legislation, certain modifications may affect the vehicle's type approval, registration, roadworthiness or compliance with applicable emissions and safety requirements.
For example, modifications affecting engine power or regulated emissions-control systems may require specific authorization, approval or updating of the vehicle documentation. In Italy, changes to vehicle characteristics such as power are regulated under Article 78 of the Italian Highway Code and related implementing provisions.
ECU Tuning AI does not represent that every software modification is legal for use on public roads.
The customer is solely responsible for determining whether the requested modification is permitted in the country and jurisdiction in which the vehicle is registered and operated.
3. Closed-Circuit / Motorsport / Off-Road Use
Software modifications that alter or disable emissions-control systems or otherwise make a vehicle no longer compliant with its approved road configuration are not intended for use on public roads.
This may include, depending on the specific application:
- DPF-related modifications;
- EGR-related modifications;
- AdBlue/SCR-related modifications;
- emissions-monitoring modifications;
- catalyst-related modifications;
- other emissions-control system modifications;
- competition-oriented calibrations;
- software modifications that alter the vehicle's approved characteristics.
Where such modifications are supplied, they are intended only for lawful applications such as closed-course motorsport, competition, testing, research, off-road use or other applications where permitted by applicable law.
Such modifications must not be used on public roads where their use is prohibited by law.
The customer is responsible for ensuring that the vehicle is not operated on public roads in a configuration that is not legally approved for road use.
This approach is consistent with the way specialist ECU file providers commonly distinguish road use from off-road/motorsport applications.
4. Stage 1, Stage 2 and Performance Modifications
Performance-oriented software modifications, including Stage 1, Stage 2 and other ECU/TCU calibrations, may alter the original characteristics and performance of a vehicle.
Depending on the modification and jurisdiction, such changes may affect:
- engine power;
- torque;
- emissions;
- fuel consumption;
- noise;
- drivetrain load;
- vehicle classification or approval;
- insurance requirements;
- roadworthiness;
- registration or vehicle documentation.
The customer is responsible for verifying whether the modification is legally permitted for the intended use.
Where a modification requires approval, certification, inspection, homologation or an update to vehicle documentation, the customer is responsible for obtaining the necessary authorization before using the vehicle on public roads.
5. Emissions-Control Systems
ECU Tuning AI may receive requests relating to emissions-control systems, including DPF, EGR, AdBlue/SCR and related ECU functions.
The technical availability of a file does not constitute authorization to use that modification on public roads.
Where a modification disables, alters or bypasses an emissions-control system, the customer must use the resulting file only for applications where such use is lawful.
ECU Tuning AI does not accept responsibility for a customer's decision to install or use such software on a road-going vehicle in violation of applicable legislation.
6. Customer Responsibility for Legal Use
The customer is responsible for:
- determining the legal status of the requested modification;
- determining whether the vehicle remains compliant with its approved configuration;
- obtaining any required authorization or homologation;
- ensuring compliance with emissions regulations;
- ensuring compliance with roadworthiness requirements;
- informing the vehicle owner or operator of any relevant limitations;
- using the supplied file only for lawful purposes.
ECU Tuning AI provides a technical software service and does not determine the legal status of a modified vehicle in every jurisdiction.
Laws and regulations may differ between countries.
7. Technical File Supply vs. Vehicle Installation
ECU Tuning AI may supply a digital software file without physically installing or programming that file into a vehicle.
The supply of a digital file does not mean that ECU Tuning AI controls:
- where the file is installed;
- which vehicle receives the file;
- who performs the programming;
- what equipment is used;
- how the vehicle is subsequently operated;
- whether the resulting configuration is legally approved.
The customer and/or installer is responsible for the subsequent installation and use of the software.
8. Vehicle and Hardware Condition
Before installing or programming a modified software file, the vehicle should be in proper mechanical and electronic condition.
Particular attention should be given to:
- engine condition;
- turbocharger;
- fuel system;
- injectors;
- sensors;
- actuators;
- cooling system;
- lubrication system;
- transmission;
- clutch;
- ECU/TCU;
- battery;
- electrical system;
- wiring;
- emissions-related components.
A software calibration is not a substitute for mechanical diagnosis or repair.
9. Programming and Flashing
The programming or flashing of an ECU or TCU must be performed using suitable professional equipment and procedures.
The installer is responsible for ensuring:
- correct vehicle identification;
- correct ECU/TCU identification;
- correct file selection;
- stable battery voltage;
- suitable programming equipment;
- correct communication;
- correct programming procedure;
- appropriate backup and recovery procedures.
Programming interruption, voltage loss, communication failure, incorrect file selection or unsuitable equipment may result in ECU/TCU malfunction.
10. Hardware-Related Failures
ECU Tuning AI is not responsible for failures caused by defective, damaged, modified or compromised hardware.
This includes:
- ECU/TCU hardware faults;
- memory failures;
- processor failures;
- wiring faults;
- voltage instability;
- battery failure;
- previous unsuccessful programming;
- water or heat damage;
- pre-existing electronic problems.
11. Tested Files
Where a file is described as tested, this means that ECU Tuning AI has subjected the file to the applicable technical verification or validation process available for that specific service.
"Tested" does not mean "guaranteed against all possible failures."
Testing cannot account for:
- defective hardware;
- mechanical faults;
- incorrect installation;
- unsuitable programming equipment;
- improper use;
- previous modifications;
- vehicle-specific conditions outside the information supplied to ECU Tuning AI.
12. Performance Results
Any performance figures or estimated improvements relating to:
- power;
- torque;
- throttle response;
- drivability;
- fuel consumption;
are indicative unless expressly guaranteed in writing for a specific vehicle and configuration.
Actual results may vary according to vehicle condition, hardware, fuel, environment, maintenance, driving conditions and other factors.
13. Original Files
Where a customer supplies an original ECU/TCU file, the customer is responsible for ensuring that the file has been lawfully obtained and that they have the right to provide it for processing.
Customers should maintain a secure backup of their original files.
14. Modified Files and Intellectual Property
The delivery of a modified file does not transfer ownership of ECU Tuning AI's proprietary calibration methodologies, technical know-how, databases, development processes or other intellectual property.
Unless expressly authorized in writing, ECU Tuning AI files may not be:
- resold;
- redistributed;
- uploaded to public databases;
- shared with unauthorized third parties;
- commercially exploited outside the agreed purpose;
- represented as the customer's own work.
15. ECU Tuning AI Database
ECU Tuning AI maintains proprietary technical databases containing original files, modified files, ECU/TCU information, calibration references and other technical information.
The existence of a file or vehicle reference in the ECU Tuning AI database does not grant any person access to the underlying file or database.
The database is a proprietary business asset and is not available for unrestricted download or copying.
16. Third-Party Programming Equipment
ECU Tuning AI does not manufacture or control third-party programming tools, diagnostic equipment or flashing platforms.
The customer or installer is responsible for ensuring that the selected equipment is appropriate, properly licensed, correctly configured and used according to the manufacturer's instructions.
17. Limitation of Liability
To the maximum extent permitted by applicable law, ECU Tuning AI shall not be liable for damage, malfunction, loss or costs resulting from:
- defective or failing hardware;
- pre-existing mechanical problems;
- pre-existing electronic problems;
- incorrect vehicle identification;
- incorrect ECU/TCU identification;
- incorrect information supplied by the customer;
- incorrect file selection;
- unsuitable programming equipment;
- programming errors;
- power interruption;
- communication failure;
- improper installation;
- unauthorized file modification;
- improper use;
- use outside the intended application;
- third-party intervention;
- operation of a modified vehicle in violation of applicable law.
Nothing in this Disclaimer excludes or limits liability that cannot legally be excluded or limited.
18. Consumer Rights
ECU Tuning AI primarily provides professional services to businesses, workshops, tuners and automotive professionals.
Where a customer qualifies as a consumer under applicable law, mandatory consumer rights and statutory protections remain unaffected by this Disclaimer.
Nothing in this Disclaimer is intended to exclude or restrict rights that cannot legally be excluded or restricted.
19. Acceptance of Responsibility
By requesting, receiving or using a software file supplied by ECU Tuning AI, the customer acknowledges that:
- ECU/TCU software is a technical product;
- installation requires appropriate equipment and procedures;
- vehicle condition can affect the result;
- the customer is responsible for the correct application and installation;
- the customer is responsible for ensuring legal compliance;
- modifications that are not approved for road use must only be used in lawful closed-course, motorsport, testing, research, off-road or other permitted applications.
